The Dackman Parties carried a commercial general liability policy through Penn National from June 1991 to August 1997 with an aggregate limit of $1,000,000. The crux of the dispute was whether support per location – a form known as CG2504 – was part of the policy during three specific policy years: 1993–94, 1994–95, and 1995–96. When that support was included, it applied a total of $1,000,000 to each insured location separately. Given the number of assets owned by the Dackman parties, the practical effect was staggering – coverage under the endorsement could reach nearly $1 billion, compared to $1 million without it.
