Skromed was given several opportunities to respond in three hearings, but largely refused to present his arguments or evidence. Meanwhile, Hartford presented exhibits – all of which came from Skomed’s own consultation – showing that Skomed’s business model revolved around stocking and selling generally prescribed products. These included SCOMED’s website and Facebook pages, state Department of Health certification, and pages for Medicare recognition as a supplier of durable medical equipment, prosthetics, orthotics and supplies, or DMEPOS. Hartford argued that these documents only reinforce the distinction between a health care provider and a medical supplier.
