The dispute relates to a 2022 motor vehicle collision in which Abdel-Rahman says he was seriously injured by GEICO insured Patricia Faircloth. In May 2023, Abdel-Rahman’s attorney sent GEICO a proposal to set the policy limit at $25,000. The letter checked all the boxes required under OCGA § 9-11-67.1, the Georgia statute governing pre-suit settlement offers in auto injury cases. This includes the time period for acceptance, the settlement amount, the party to be released, the nature of the release and what the claimant will provide to the releasee, and the claims for release – five important terms the law says must be part of any such offer.
