The Louisiana Supreme Court has reset trial deadlines in bankruptcy cases under insurance payout rules.

The matter started simply enough. The property in question was insured under a homeowners policy taken out by Emma Bryan through Capital Preferred Insurance Company, which had merged with Southern Fidelity Insurance Company. Hurricane Ida struck Louisiana on August 29, 2021, causing damage to insured property. Emma Bryan’s children – Cynthia Bryan, Aubrey Bryan Jr., Aunya Bryan and Glenda Bryan – claimed rights to the proceeds under the policy. Southern Fidelity paid $23,097.55 on March 1, 2022, which was an unconditional settlement of the claim. Then, on June 15, 2022, a Florida court put Southern Fidelity into receivership, making it a bankrupt insurer under Louisiana law. The Louisiana Insurance Guaranty Association (LIGA), which steps in to handle claims when an insurer fails, inherited the file.
