According to the filing, the problem started with David Friend, a tenant at Portland’s Solace apartment complex. Friend filed a class action accusing Marathon — which, the filing said, also manages other Oregon complexes including Glendovir Woods, Bridgton, McKinney Lanes, Bell Tower, Willamette Estates and Eris — of breaking the state’s landlord-tenant laws in multiple ways. The allegations include monthly utility charges billed without proper documentation, an unclear “meter reading” fee charged to renters, lease provisions that allegedly limit tenants’ legal remedies, and renter’s insurance requirements that do not comply with Oregon regulations, according to Friend. Marathon and the property’s owner, VAA Investments, LLC, are accused of violating multiple sections of the Oregon Residential Landlord and Tenant Act.
