After surgery, medical evidence revealed that Mooney’s work-related radiculopathy had coincided with those pre-existing cervical conditions. On May 5, 2021, Legacy Health amended its approval to cover the combined conditions of pre-existing fusion at C6-7, Brown-Séquard syndrome, and cervical spondylosis. Then, just a day later on May 6, 2021, the employer reversed course and denied the same joint status, pointing to the medical opinion that the surgery had resolved the radiculopathy and it was no longer the main driver of Mooney’s disability or treatment needs.
