Tokio Marine sues Allied World, alleging its tactics inflated the deal

It just got worse, the complaint says. On November 12 – five days before the trial – Allied World introduced a new plan on the all-carrier call: calling the shopping center dangerous, shifting the blame to Ross Dress for Less, a defendant already dismissed from the case. The filing described it as an attempt to “hijack” the defendants. The next day, an Allied World adjuster emailed the carriers explaining the approach: “Right now, the plan is to ask for a continuance, if a continuance is not granted, which I believe it will be given discovery status etc., we will reconsider whether new counsel will take over the case.”
